1. Acceptance of terms

By accessing or using our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access the service. These Terms and Conditions apply to all visitors, users and others who access or use our service.

2. Property and use of content

All content on our platform, including but not limited to text, images, graphics, logos, audio clips, digital downloads, data compilations and software, as well as our products, services and any associated intellectual property (such as registered trademarks, patents, trade secrets and copyrights), are the exclusive property of Dolfs SpA or its content providers. This intellectual property is protected by international copyright, trademark, patent, trade secret and other intellectual property laws.

You are granted a limited, non-exclusive and non-transferable license to access and use our content, products and services for your personal use. This license allows you to use our products and services for their intended purpose, access and view content on our platform for informational and personal purposes, and make purchases and interact with our services as an end consumer.

This license does not allow you to resell, redistribute or commercially exploit our products, services or content without our express written permission; copy, modify, reverse engineer, decompile or create derivative works based on our products, services or content; use our intellectual property, including logos, trademarks or copyright-protected material, without our express written consent; or remove, alter or conceal any copyright, trademark or other property rights notices from our content, products or services.

3. Links to third party websites

Our service may contain links to third-party websites or services that are not owned or controlled by Dolfs SpA. We have no control over, and assume no responsibility for, the content, privacy policies or practices of third-party websites or services. You acknowledge and agree that Dolfs SpA shall not be responsible, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on such content, goods or services available on or through such websites or services.

4. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Dolfs SpA, its affiliates, agents, directors, employees, suppliers or licensors be liable for indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, this service. Our total liability for any claim arising under these Terms and Conditions shall be limited to the amount you paid us, if applicable, for use of the service during the last three months.

5. Indemnification

You agree to defend, indemnify and hold harmless Dolfs SpA and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debts, and expenses (including but not limited to attorneys' fees), resulting from or arising out of a) your use and access to the service, by you or any person using your account and password; b) a violation of these Terms and Conditions; or c) your violation of any third-party rights.

6. Modifications to terms and conditions of use

These Terms and Conditions of Use are effective from the moment you access or use our services and remain in effect while you continue to use our services.

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after any revision becomes effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must immediately cease using our services.

We recommend that you periodically review this page to stay informed of any changes. The "Last updated" date at the beginning of these terms indicates when they were last modified.

7. Prohibition of web scraping and unauthorized use of APIs

Web scraping, automated data extraction, crawling, or any similar method of automated information collection from our services, platforms or systems is strictly prohibited without express written authorization from Dolfs SpA.

The use of our APIs, application programming interfaces, endpoints or any other technical access mechanism is restricted exclusively to systems, artifacts, applications or consumers that have been expressly authorized in writing by Dolfs SpA. Use is only permitted from:

  • Our own official systems and platforms of Dolfs SpA
  • Systems, applications or consumers specifically authorized in writing by Dolfs SpA within the scope and purpose for which they were authorized
  • Systems of clients with active service contracts that include explicit authorization for API use, and only within the limits and conditions established in such contracts

It is strictly prohibited to use our APIs from any system, artifact, application or consumer that has not been expressly authorized in writing by Dolfs SpA. Unauthorized access from third-party systems, unauthorized applications or any other unauthorized consumer constitutes a violation of these terms.

The following is expressly prohibited:

  • Using our APIs outside the authorized scope or for purposes not contemplated in the service contract
  • Integrating our APIs into third-party systems without prior written authorization
  • Reverse engineering, decompiling or attempting to discover the internal structure of our APIs
  • Sharing, reselling or redistributing access to our APIs to third parties
  • Using our APIs to create competing services or derivative products
  • Performing automated scraping of our web services, interfaces or content
  • Employing bots, automated scripts or any tool that overloads or interferes with the normal operation of our systems

These prohibitions are protected by Law No. 17,336 on Intellectual Property of Chile, Law No. 19,628 on Protection of Privacy, and other applicable regulations that protect intellectual property, databases and computer systems. Non-compliance with these provisions constitutes a violation of our intellectual property rights and may result in legal actions, including but not limited to:

  • Request for immediate cessation of unauthorized activity
  • Claim for damages
  • Precautionary measures and criminal actions as appropriate
  • Immediate termination of any active service contract

Dolfs SpA reserves the right to monitor, detect and prevent any unauthorized use of our services and APIs, using detection technologies and appropriate security measures.

8. Applicable law and jurisdiction

These Terms and Conditions shall be governed and construed in accordance with the laws of Chile, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions of these Terms shall remain in effect. Any dispute arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Chile.
